Evictions- Filing Services

Evictions are filed in the County Court of the County where the property is located.  The first step is to terminate the tenancy. ( Notice to Quit and or Termination )

The cost of an uncontested case which includes the filing fees, service of process, the sheriffs fee to execute the writ of possession. Evictions generally take three to four weeks from filing to execution of the writ of possession.

Most of the forms you will need to get started are provided on the Landlord Forms page.  While a notice to cure lease violation or a notice of non-renewal can be emailed to the tenant,  The notice to quit must be handed to the Tenant or Posted on the door.   If the notice to quit  is mailed,  five additional days must be added to the due date.   If you can not post the notice to quit yourself, or do not have someone who can post it for you, give us a call or send us an e-mail.  We can have your notice posted/served for you, prices range depending on the location and State.

 

Eviction actions that proceed through the courts take different times.  In most cases, we can have the tenant out of the property within weeks not months.   You will have to arrange for someone meet the sheriff at the property to change the locks and/or  remove the tenant’s personal belongings from the premises At the end of most evictions.

*We can also set up for a company to go out to your property for the lock out service and remove everything from left behind after the eviction . (EX: bag the home contents, remove furniture and place on the curb and broom sweep or full cleaning)

* We also have contractors ready for Getting the Apt back into rental Condition at lock out we can take pictures of the entire home and take notes that we send to our clients, an estimate for repainting and repairs can be given so you know the costs for getting the unit ready to rent.

Some States landlord-tenant law provides that the prevailing party is entitled to a judgment for their attorney’s fees and costs, Some times damage caused by the Tenants can be added to this. But as many Landlords know, that is what the security deposit is for.

 

FYI REPRESENTATION LAWS

In some States a property manager may file an action for possession (but not money damages) with the written authorization of the property owner,  but if the matter is contested and gets complicated an attorney should be retained.  Any natural person owning a property may file an eviction Pro Se. (on their own as the owner).  A corporation or an LLC is required to use an attorney.  No non-attorney can file any motions in a contested case (but some judges allow some motions and orders to be filed by the managers and agents in evictions)

 

ACTION FOR POSSESSION AND MONEY DAMAGES

In order to start the eviction: Its best to file a copy of your lease with the eviction (if there is one), a copy of the signed and dated notice to quit that was delivered to the tenant (i.e. 3 day notice, 7 day notice to cure, 15 day notice of non-renewal),  and full rental payment history and repairs that have been made to the apt. Keeping great notes, Texts and bookkeeping with receipts will help you prove your case in front of the Courts.  We bill clients through our Business Acct with pay-pal. (We do not keep or handle any credit card payments for clients). prices below are for Florida Courts. Other States have other fees.

* We can E-File if you wish, to have the Eviction filed and is time sensitive.  Other than that we hand deliver to the Clerks Offices and Make payment for Filing the Eviction.

 

In order to obtain a money judgment against the tenant you need to serve the tenant personally with the summons. This may require the issuance of additional summons.   Motions for money judgments usually require an evidentiary hearing.  This will require the attendance of a witness or an Affidavit from you signed and notarized for us to take to court , documentation of your claim of what you have paid out of pocket and or your accounting for rent owed with receipts and notes, these are an additional hearing court date to be paid.
