The Clerk of Courts has been established by the Florida Constitution to serve the public in three primary areas including Clerk of the Circuit and County Courts, Clerk to the Board of County Commissioners, and County Recorder. Within these areas, the Clerk of Court, as an elected public trustee, sets in place at the county level, a system of “checks and balances” which has been proven to service the public well.

County Civil

The County Civil Division handles civil actions in which the damages being sought or the matter in controversy total $5,000.00 to $15,000. When filing a case in County Court, you must prepare all of the necessary paperwork yourself or have an attorney do it for you. The clerk’s office cannot refer an attorney to you. There are no forms to hand out, nor does the Clerk prepare any paperwork in County Court.

Service

Once the case is filed, it must be served by either the Sheriff’s Office or by private process server. A list of process servers is available in the County Civil Department, however, the Clerk may not refer a process server to you. The Clerk’s Office has a 20-day Summons form available that can be prepared for a cost of $10.00 per defendant. The Gulf County Sheriff’s Office charges $40.00 per defendant to serve your documents.
